Starting from January 1, 2021, a new pre-trial procedure for settling consumer disputes with credit institutions is in effect.
If the credit organization refuses to satisfy the consumer's demands, before appealing to the court, the consumer should apply to the Financial Ombudsman to settle the dispute.
The position of the Financial Ombudsman was introduced by Federal Law No. 123-FZ of June 4, 2018 “On the Ombudsman for the Rights of Consumers of Financial Services” (hereinafter referred to as the Law).
The Financial Ombudsman considers property claims of consumers the amount of which does not exceed 500,000 rubles.
A consumer's application to the Financial Ombudsman may be sent electronically via a personal account on the official website of the Financial Ombudsman , Gosuslugi platform or on paper.
Consumers' appeals are accepted and considered by the Financial Ombudsman free of charge.
Prior to sending an appeal to the Financial Ombudsman, the consumer shall apply to the credit organization for restoration of the violated right. Such a procedure of claim is established by the Law, being mandatory for consumers.
